MONDAY, JULY 11, 1:30PM UPDATE: Two men were acquitted of attempted murder today in Supreme Court after a shooting victim refused to testify.

Dunn-Ya Taylor, 22, and Jah'Mico Trott, 23, were found not guilty of trying to kill David Godwin by a jury on Puisne Judge Carlisle Greaves’ direction.

Mr Godwin was shot at on September 23, 2010 in St Monica’s Road, Pembroke.

He refused to come to court today and testify despite being subpoenaed. Warrants had also been issued for his arrest.

The trial began this morning when prosecutor Susan Mulligan opened the Crown’s case to the jury.

Ms Mulligan said: “The Crown will lead evidence to prove that Jah’Mico Trott borrowed Dunn-Ya Taylor’s bike that day and he with another man drove by as Mr Godwin was walking in his yard.

“Mr Trott, the passenger, took out a gun and shot Mr Godwin.

“You will probably find that that’s an attempt to kill somebody.

“You will hear that Mr Taylor loaned his bike to Mr Trott so that if someone got the license plate, the bike wouldn’t be connected to Mr Trott.”

After finishing her opening speech Ms Mulligan called the first eyewitness.

But the man, who cannot be named for legal reasons, told the court he did not recall the day in question, the incident or even giving police statements.

Ms Mulligan applied to have the man treated as a hostile witness but Mr Greaves denied the application.

Ms Mulligan then told the court she was unable to proceed.

The jury was instructed to find both men not guilty on all charges. The defendants left court as free men just before the lunch break.

Mr Trott said: “I’m happy to be free.

“There’s a God above.

“The right verdict was made.”

His mother Rosa Parkes said: “It’s a long day coming and I’m glad it’s over with. It’s been dragging on and on and on.

“He [Jah’Mico] is overwhelmed.

“He just wants to go and start his life and finish his education.

“There’s a God above and He doesn’t sleep.”
