Chris Furbert of the Bermuda Industrial Union told a press conference the Department of Public Transportation had not followed the right procedures in getting a drug test from the female driver after a minor accident.
The driver was suspended on June 24 after an incident involving two buses and has been off work on no pay ever since.
Mr Furbert said the department had “dropped the ball” in failing to get a urine test from the driver after the accident and could not now require her to take a hair follicle drug test.
Mr Furbert said a hair follicle test was “out of the question”.
He added: “From day one the drugs policy hasn’t been followed. They can’t change the policy like this, they have to be consistent.
“There were two bus operators involved in this and only one has been required to be drug tested.
“The division has given the department 24 hours to put the sister back in the seat with no loss of pay.
“If she is not reinstated it will go back to the division to make a decision.”The Bermuda Sun bids farewell...
